The AutoSelecta website (the “Site”) is operated by Future Creative Group Ltd, trading as AutoSelecta, registered in England and Wales, with its registered office at:

 (“AutoSelecta”, “we”, “us”, or “our”).

By accessing, registering for, logging into, or otherwise using this Site, whether as a guest or registered user, you agree to be legally bound by these Terms and Conditions (“Terms”).
If you do not agree to these Terms, you must not use this Site.

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of those changes.

1. Ownership & Intellectual Property

All content on this Site, including but not limited to text, images, graphics, logos, branding, platform design, software, databases, and functionality (“Site Content”) is owned by or licensed to Future Creative Group Ltd.

AutoSelecta and its associated branding are protected by intellectual property laws.

You may not:

• Copy, reproduce, republish or distribute Site Content
• Use our branding without written consent
• Scrape, data mine, or extract data using automated systems
• Attempt to register or challenge ownership of our intellectual property

Any unauthorised use may result in legal action.

3. Nature of the Platform

AutoSelecta operates as a managed vehicle auction access platform.

We:

• Provide access to Japanese vehicle auctions
• Require user verification (KYC)
• Facilitate wallet-backed bidding
• Use licensed agents to place bids on behalf of approved users
• Coordinate settlement, export and UK delivery

AutoSelecta is not the seller of vehicles listed in external Japanese auctions. Vehicle information is provided by third parties and auction houses. While we aim to provide accurate information, we cannot guarantee completeness or accuracy.

Users are responsible for conducting their own due diligence.

4. Account Registration & Verification

To bid, you must:

• Register an account
• Complete identity verification (KYC)
• Provide accurate payment details

We reserve the right to:

• Refuse or revoke account access
• Suspend bidding rights
• Request additional documentation

Failure to provide accurate information may result in account termination.

5. Wallet & Bid Freezing

To submit a bid:

• You must fund your AutoSelecta wallet
• 100% of your bid amount will be temporarily frozen

If:

• You do not win → funds are released
• Your bid is not selected internally → funds are released
• You win → settlement is required within stated timelines

Failure to complete payment after winning may result in:

• Forfeiture of funds
• Account suspension
• Legal recovery of losses

6. Fees & Charges

Fees are outlined separately on our Fees page and may include:

• 5% Buyer’s Premium (capped at £6,000)
• £2,500 UK mainland transport fee
• Applicable import taxes, VAT and duties

We reserve the right to update pricing with reasonable notice.

Government-imposed charges are outside our control.

7. User Conduct

You agree not to:

• Use the Site unlawfully
• Interfere with platform operations
• Attempt unauthorised system access
• Upload malicious software
• Submit false or misleading bids
• Circumvent internal bid selection systems

We may suspend or terminate accounts for violations.

8. User-Generated Content

If the Site allows reviews, comments, or submissions:

• You remain responsible for your content
• You grant AutoSelecta a non-exclusive, royalty-free, worldwide licence to use submitted content
• Content must not be defamatory, illegal, abusive, or infringing

We reserve the right to remove content at our discretion.

9. Third-Party Links

The Site may contain links to third-party websites.

We do not control or endorse third-party content and accept no responsibility for their services or policies.

10. Disclaimer

The Site and all content are provided “as is”.

We do not guarantee:

• Continuous availability
• Error-free operation
• That auction listings are free from inaccuracies

Vehicle purchases are subject to auction house rules and international regulations.
You use the Site at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law:

Future Creative Group Ltd shall not be liable for:

• Indirect or consequential loss
• Loss of profits or business
• Delays caused by shipping providers
• Auction house errors
• Government delays or import regulation changes

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.

12. Termination

We may suspend or terminate your access to the Site if:

• You breach these Terms
• Fraudulent activity is suspected
• Payment obligations are not met
• Required verification fails

Termination does not affect outstanding payment obligations.

13. Data Protection

We process personal data in accordance with our Privacy Policy and UK GDPR requirements.

We may disclose information:

• To comply with legal obligations
• To protect platform integrity
• In response to lawful requests from authorities

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

15. Modifications to the Site

We may:

• Update platform functionality
• Restrict access
• Suspend services
• Modify auction access

Without prior notice where reasonably required.

16. Entire Agreement

These Terms, together with our Privacy Policy and related policies, constitute the entire agreement between you and Future Creative Group Ltd trading as AutoSelecta.

If any provision is found unenforceable, the remaining provisions remain valid.
